Point Frederick objectors to receive notice after flat-building refusal
The Local Planning Panel rejected the amended proposal for 49 Masons Parade in a unanimous 4 - 0 vote and ordered Central Coast Council to notify objectors and external referral bodies.
Objectors to a proposed residential flat building at 49 Masons Parade, Point Frederick, are to be notified after the Central Coast Local Planning Panel unanimously refused the amended application in a 4 - 0 vote.
The panel found the proposal was not substantially the same development as originally approved. It therefore could not be determined as a modification application under section 4.56(1)(a) of the Environmental Planning and Assessment Act 1979.
Central Coast Council was directed to notify both the objectors and external referral bodies of the refusal.
The application, DA/47050/2015/B, sought approval for a residential flat building and demolition of existing structures. The panel cited excessive height, bulk and scale, reduced solar access, increased floor space, privacy impacts and adverse streetscape outcomes among its concerns.
Its reasons also included inconsistency with Chapter 5 of State Environmental Planning Policy (Precincts, Regional) 2021, the Apartment Design Guide under the Housing SEPP and the Gosford City Centre Development Control Plan 2018. The panel found the site was not suitable for the proposed intensified development and that the proposal was not in the public interest.
Notification orders were also made for another decision. External referral bodies are to be notified of the approved shop-top housing application at 191 Main Road, Toukley, which is subject to draft conditions.
The Toukley application number is inconsistent in the panel’s documents. It is listed as DA/1929/2024 in the item heading and DA/1969/2024 in the decision text.
Three other applications were approved subject to conditions: an attached dual occupancy and demolition of existing structures at 1 Wilson Road, Terrigal; a telecommunications facility at 184 Brisbane Water Drive, Point Clare; and a telecommunications facility at 225 Main Road, Toukley.
The Point Clare and 225 Main Road approvals included variations to the Central Coast Local Environmental Plan 2022 building-height standard.
The next Local Planning Panel meeting is scheduled for 20 August 2026.
