Point Frederick flat-building amendment rejected in unanimous panel vote
The 4-0 refusal at 49 Masons Parade followed findings of excessive height, bulk and scale, reduced solar access and privacy impacts.
A proposed residential flat building at 49 Masons Parade, Point Frederick, has been refused unanimously after the Central Coast Local Planning Panel found the amended scheme unacceptable and substantially different from the development originally approved.
The 4-0 decision applies to DA/47050/2015/B, which sought approval for a residential flat building and demolition of existing structures. The panel found the application could not be assessed as a modification under section 4.56(1)(a) of the Environmental Planning and Assessment Act 1979.
The panel cited excessive height, bulk and scale, reduced solar access, increased floor space, privacy impacts and adverse streetscape outcomes. It also found the proposal did not adequately satisfy the design quality principles and relevant requirements of the Apartment Design Guide under the Housing SEPP.
The scheme was found to be inconsistent with relevant provisions of Chapter 5 of State Environmental Planning Policy (PrecinctsRegional) 2021, including clauses 5.25, 5.26 and 5.45. The panel also found it inconsistent with the relevant objectives and controls of the Gosford City Centre Development Control Plan 2018.
The panel said the site was not suitable for the proposed intensified development outcome and that the proposal was not in the public interest.
Objectors and external referral bodies are to be notified of the refusal. Any further planning or appeal action is not recorded in the panel's decision.
The Point Frederick refusal was one of five substantive planning outcomes considered by the panel on 23 July 2026. Development applications for an attached dual occupancy at 1 Wilson Road, Terrigal, a telecommunications facility at 184 Brisbane Water Drive, Point Clare, and shop-top housing at 191 Main Road, Toukley, were approved subject to conditions. The panel also varied the building-height standard for the Point Clare facility.
Planning Proposal RZ/111/2020, covering 945 Old Pacific Highway and 66 Myoora Road, Somersby, was refused unanimously by a 3-0 vote. The next Local Planning Panel meeting is scheduled for 20 August 2026.
