130 submissions considered before Killara flat-building proposal refused
The panel refused the 2 Killara Avenue application after considering 130 submissions, rejecting requests to vary building-height and other development standards.
Residents’ views were a central part of the Ku-ring-gai Local Planning Panel’s refusal of a proposed residential flat building at 2 Killara Avenue, Killara, with 130 submissions considered before the unanimous vote on 27 July 2026.
The application, eDA0017/26, proposed demolishing existing structures and constructing a residential flat building with associated works. The panel refused development consent, adopting the reasons in an independent planning consultant’s Development Assessment Report.
The panel also rejected requests to vary the Height of Buildings development standard under SEPP Housing 2021, along with requirements for multi-dwelling housing and residential flat buildings under Clause 6.6 of the Ku-ring-gai Local Environmental Plan 2015.
It found the requests did not meet the requirements of Clause 4.6. The panel also found that strict compliance with the standards was neither unreasonable nor unnecessary in the circumstances, and that there were not sufficient environmental planning grounds to justify the variations.
The 130 submissions were received during notification under Ku-ring-gai Council’s Community Participation Plan and were considered as part of the determination. The panel’s refusal means the proposal cannot proceed as lodged.
Any future application for 2 Killara Avenue would need to address the refusal reasons and the planning-standard issues. No timeframe for a revised proposal was stated.
The panel also unanimously refused eDA0013/26, involving alterations and additions to retail and commercial buildings at 194-198 Mona Vale Road, St Ives, and a proposed change of use to the St Ives Tavern, including food, drink, entertainment and televised sport.
That application attracted 12 submissions. The refusal was for the first reason in the Development Assessment Report, relating to contamination. The panel also noted that the applicant had reduced the proposed hours from 9am to 2am, Monday to Sunday, to 9am to midnight, Monday to Sunday. It accepted that the reduction would lessen impacts between midnight and 2am.
