North Avoca restaurant proposal refused after Body Corporate consent missing
The Central Coast Local Planning Panel voted 4-0 against the proposed licensed restaurant and cafe at 15/21-23 North Avoca Parade.
A proposed licensed restaurant and cafe at 15/21-23 North Avoca Parade, North Avoca, will not proceed in its submitted form after the Central Coast Local Planning Panel refused the application, citing the absence of Body Corporate consent.
The panel voted unanimously, 4-0, to refuse development application DA/2004/2024/A under section 4.16(1) of the Environmental Planning and Assessment Act 1979. It found the application had not been properly made because it was not accompanied by Body Corporate consent.
The panel also found the proposal unsatisfactory against the relevant planning considerations under section 4.15(1) of the Act. It was not satisfied the proposed modification was substantially the same development as originally approved, meaning the application could not be determined as a modification under section 4.55.
The proposal was also found to be inconsistent with the objectives of the E1 Local Centre zone under the Central Coast Local Environmental Plan 2022.
Other reasons for refusal included potential unreasonable impacts on the amenity of residential neighbours and insufficient information about potential noise impacts. The panel also cited inadequate information to address a car parking shortfall and its associated impacts, as well as insufficient information about toilet facilities.
The panel concluded the proposal was not in the public interest. Objectors and external referral bodies are to be notified of the decision.
The North Avoca application was one of four development applications refused by the panel on 17 September. The others involved an amended dwelling, swimming pool and retaining-wall proposal at 1 Yumbool Close, Forresters Beach; a proposed childcare centre at 23-35 Albert Warner Drive, Warnervale; and co-living housing and demolition of existing structures at 76 Hills Street, North Gosford.
The next Central Coast Local Planning Panel meeting is scheduled for 22 October 2026.
