Faster Toowoomba lot titling comes with exclusions and a $20,000 bond

A new Toowoomba Regional Council pathway could cut eligible lot-registration timeframes to about six weeks, but it excludes Material Change of Use applications and other development types, including Community Title Scheme and Building Format Plan applications. Developers must also meet new documentation, certification and bonding requirements.

The opt-in Early Plan Sealing Policy allows eligible survey plans to be sealed before every minor development obligation reaches formal On Maintenance status. It is intended to shorten the gap between construction and title registration for new lots.

The faster pathway is not available to every applicant. Essential water, sewer, inter-allotment drainage and earthworks must be completed and accepted before early sealing can be considered. Applicants must also provide related As Constructed documentation, site inspections and Registered Professional Engineer of Queensland certification where required.

Minor works can generally be deferred for up to three months under a due-completion bond worth 150 per cent of the outstanding work. An As Constructed bond has a minimum value of $20,000, while an early plan-sealing fee applies to relevant applications under changes to the 2026/27 Register of Fees and Charges.

The controls are intended to prevent new lots being titled before they are safely serviced and to protect future owners and Council assets while minor work is completed. The policy’s housing and titling benefits will therefore be limited to applications that meet its eligibility rules.

The policy followed a review that began in August 2025 and consultation with industry, neighbouring councils and internal stakeholders. Toowoomba Regional Council also delegated future operational amendments to the Chief Executive Officer.

Developers must opt into the process when lodging an eligible application and satisfy the construction, certification and bonding conditions before early plan sealing is considered.
