$20,000 bond backs Toowoomba policy for earlier lot titles

Eligible developers can seek earlier lot titles, but essential services must be accepted first and deferred minor works require 150 per cent security. An As Constructed bond starts at $20,000.

Developers seeking earlier lot titles in the Toowoomba Region will have to meet strict servicing and documentation requirements, while minor unfinished works can be deferred under a 150 per cent bond and an As Constructed bond of at least $20,000.

Toowoomba Regional Council adopted the opt-in Early Plan Sealing Policy on 14 July. The policy allows eligible survey plans to be endorsed before every minor finishing job is complete, with Council estimating title-registration timeframes could fall to about six weeks.

Water and sewer reticulation, inter-allotment drainage, earthworks, retaining walls, roads and associated drainage must be completed and accepted before early sealing proceeds. Developers must also submit survey, engineering and quality-assurance records, including sewer and stormwater CCTV where required, plus certification from a Registered Professional Engineer of Queensland.

Landscaping, footpaths, street furniture, stormwater-basin planting and minor defects can be deferred. Those works must generally be completed within three months of Council endorsing the survey plan and secured by a Due Completion Bond worth 150 per cent of their verified cost. The bond has a minimum value of $10,000, and Council can call it if a developer defaults.

The policy also sets an As Constructed Bond at 2.5 per cent of the value of works, with a minimum of $20,000, where a partial as-constructed package is submitted. A maintenance security deposit of 10 per cent of the value of works, with a $10,000 minimum, applies to all applications under the policy.

The process is not available for every development type. Material Change of Use applications, Community Title Scheme applications and Building Format Plan applications are excluded.

A Council site walkover inspection is required before endorsement, with at least five business days' notice for bookings. Once all requirements are accepted, Council will endorse the survey plan within five business days. Formal On Maintenance will not begin until all assets are completed, inspected and accepted.

The safeguards are intended to stop new lots being titled before they are safely serviced, while allowing eligible developers to reach the registration stage sooner. Council also delegated future operational amendments to the Chief Executive Officer and adopted related changes to the 2026/27 Register of Fees and Charges.
