Four submissions, lapsed consent: North Turramurra aged care rebuild refused
The Ku-ring-gai Local Planning Panel rejected the proposal for 34 Curagul Road after finding its Clause 4.6 variation requests insufficient and identifying design, height and landscaping concerns.
A proposal to demolish the aged care facility at 34 Curagul Road, North Turramurra, and build a replacement has been refused after four community submissions were considered by the Ku-ring-gai Local Planning Panel.
The unanimous decision on 28 September rejected development application eDA0184/26. The panel supported modernising the site in principle, but found the requested variations under Clause 4.6 of the Environment Planning and Assessment Act 1979 insufficient to justify approval. It also noted that the previous consent had lapsed.
The panel said changes to the proposal could improve the four-storey section, the building’s overall height and its interface with adjoining properties. It also identified the need for a lower building, more landscaped area across the site and changes to plant species to maintain and enhance the site’s landscaped character under the Ku-ring-gai Development Control Plan.
Greg Boston, representing the applicant, addressed the panel before the determination. The panel said a management plan for evacuating residents and staff in the event of a bushfire would be required if consent were granted.
The existing facility will not be demolished or replaced under eDA0184/26. The applicant may seek a review under section 8.2 of the Environment Planning and Assessment Act 1979.
Any revised proposal would need to address the reasons for refusal and provide stronger justification for requested Clause 4.6 variations.
At the same meeting, the panel unanimously approved development application eDA0250/26 for alterations and additions to the existing dwelling at 21 Kimberley Street, East Killara. The works include a double garage, swimming pool and associated works.
That approval accepted a Clause 4.6 request to vary the building-height standard. The consent will lapse if the approved works are not physically commenced within five years of the Notice of Determination. No submissions were received for the East Killara application.
