A proposal for demolition works and a seven-storey co-living housing development at 3-5 Hampton Court Road, Carlton, has been refused by the Georges River Local Planning Panel.

At its 7 May meeting, the panel unanimously rejected development application DA2025/0575 under section 4.16(1)(b) of the Environmental Planning and Assessment Act 1979. The public minutes show the panel also noted the application is currently before the Land and Environment Court for determination.

The minutes list a series of planning reasons for refusal. They include non-compliance with parts of the State Environmental Planning Policy (Housing) 2021 covering communal living, communal open space and building separation, as well as non-compliance with Georges River Local Environmental Plan 2021 controls on building height, design excellence and landscaping.

The panel also found the application did not satisfy parts of the Georges River Development Control Plan 2021 on site isolation, building setbacks and street interface, and waste management. It said the proposal was unsatisfactory because of inadequate basement access and because insufficient information had been provided to properly assess the impacts of the development and the suitability of the site.

Among the information issues listed in the minutes were the absence of an assessment quantifying the impacts of non-compliant setbacks compared with a compliant scheme, inconsistencies between the acoustic report and plan of management on occupancy numbers, and missing details relating to Sydney Water infrastructure on the plans.

For nearby residents in Carlton, the panel decision means this proposal was not approved at the local planning panel stage. The minutes also record that the panel inspected the site and nearby locality before making its determination.

The matter is not necessarily finished. The panel expressly noted the Hampton Court Road application is already before the Land and Environment Court, so any final outcome may also depend on that process.
