Georges River panel refuses Beverly Hills restaurant plan
Georges River Local Planning Panel unanimously refused DA2025/0397 for 143 Stoney Creek Road, citing access, trees, acoustics and amenity impacts.
Georges River Local Planning Panel has refused a restaurant proposal at 143 Stoney Creek Road, Beverly Hills, by a unanimous vote at its 5 March meeting at the Civic Centre, Hurstville.
The panel rejected DA2025/0397 for demolition works and the construction and use of a restaurant on Lots 2 and 3, DP 1205598. It said the proposal failed to provide adequate vehicular access, did not comply with the council’s tree management policy, and relied on an acoustic report that did not meet relevant industry standards.
The refusal also cited impacts on neighbourhood amenity, including noise and lighting linked to the development’s proposed operating hours. The panel found the project was not suitable for the site and was not in the public interest. The refusal was made under section 4.16(1)(b) of the Environmental Planning and Assessment Act 1979.
Before the meeting, the panel inspected the site and nearby locality. The minutes record submissions from Costa Dantos, Ali Ghacham and Gavin Burgess, along with applicants Kale Langford and Martin Squires.
The panel noted the applicant had lodged additional information after council had completed its assessment. If the applicant seeks a review under Division 8.2 of the act, the panel suggested several changes, including restricting operating hours to 6am to 11pm seven days a week rather than 24/7, with no activity outside those hours, including deliveries or waste collection.
It also suggested removing parking spaces 25 to 29, relocating the building footprint closer to the Cambridge Street frontage, providing a greater rear landscape setback and acoustic screening along the south-west boundary, and reducing the two order stations to one and moving it to the Stoney Creek Road frontage.
Other suggested changes were acoustic treatment for the bin room, improved ventilation, tighter lighting controls and the submission of updated acoustic and tree-preservation information with revised plans.
The same meeting also backed a planning proposal for the Affordable Housing Contribution Scheme and sent it to council for endorsement. The panel commended the initiative and asked for clearer explanation of how the scheme works when council collects funds rather than acquires property.
