Burwood Council advances LEP changes tied to community infrastructure in high-density areas
Council endorsed a Gateway request for amendments to Burwood LEP 2012 clauses 4.3A and 4.4A, with public exhibition to follow if the state issues a Gateway determination.
Burwood Council has endorsed a request for Gateway determination for planning changes aimed at linking extra height and floor space provisions to the delivery of community infrastructure across a broader catchment of high-density development areas in the Burwood local government area.
According to the 28 April 2026 council minutes, the proposal would amend clauses 4.3A and 4.4A of the Burwood Local Environmental Plan 2012. Council resolved to submit the planning proposal to the NSW Department of Planning, Housing and Infrastructure.
The minutes say the proposed amendments seek to expand bonus floor space provisions beyond the Burwood Town Centre to higher-density zones, including R1 General Residential, R3 Medium Density Residential, E1 Local Centre and MU1 Mixed Use.
Council also resolved that, if a Gateway determination is issued, the planning proposal will go on public exhibition for at least 28 days, with community consultation to be carried out under the Environmental Planning and Assessment Act 1979.
The minutes state the proposal is intended to help enable the delivery of community infrastructure to a broader catchment of high-density developments in the Burwood LGA. They also say the changes would require developers to achieve design excellence, respond to desired local character and improve sustainability performance, while increasing housing capacity.
A related Draft Burwood Planning Agreement Policy 2025 remains under review following community submissions and will be reported back to council at a later date, according to the minutes.
