58 Waratah Street dual occupancy approved for two-lot subdivision

An existing dual occupancy at 58 Waratah Street, Croydon Park, will be divided into two Torrens Title lots after the Burwood Local Planning Panel approved the subdivision with conditions on 17 September.

Development Application DA.2026.57 covers the two-lot subdivision and minor ancillary works on land zoned R2 Low Density Residential. The approval allows the existing dual occupancy to be held across two property titles.

The application sought a variation of more than 10 per cent to clause 4.1B(3) of the Burwood Local Environmental Plan 2012. The clause sets the minimum street frontage for dual occupancies in the R2 zone, bringing the application before the panel for determination.

The panel accepted the applicant’s Clause 4.6 written request. It found that complying with the street-frontage standard was unreasonable or unnecessary in the circumstances and that sufficient environmental planning grounds supported the variation.

The application was one of three development matters determined by the panel on 17 September. At 106-108 Wentworth Road, Burwood, the panel approved a Section 4.55(2) modification to an approved residential flat building, subject to conditions in Council’s assessment report. It revoked a previous refusal dated 15 April 2026 after finding the amended proposal addressed the earlier reasons for refusal.

For 58 Waratah Street, the panel’s approval allows the existing detached dual occupancy to be subdivided into two Torrens Title lots, subject to the approval conditions.
