Maroubra home plan cleared for 301 Malabar Road after height variation approved
Randwick’s planning panel has approved amended consent for 301 Malabar Road, allowing a lift, garage conversion, balcony and pool deck works after accepting a variation to the height standard.
A redesigned home at 301 Malabar Road, Maroubra, has won approval after Randwick’s planning panel granted amended consent for the property on 14 July. The panel was satisfied DA/157/2021 had been activated and had not lapsed, accepted the applicant’s request to vary the maximum building height standard, and approved DA/258/2026.
The approval covers reconfiguration of the dwelling’s internal layout, a new lift, conversion of the attached carport to a garage, a new balcony at loft level, changes to the pool deck and alterations to structural columns at basement and lower ground floor levels.
Consent was granted under sections 4.16 and 4.17 of the Environmental Planning and Assessment Act 1979, subject to conditions in the supplementary report.
The height variation was central to the case. The panel accepted that compliance with the maximum building height standard in Clause 4.3 of the Randwick Local Environmental Plan 2012 was unreasonable and unnecessary in the circumstances, and that there were sufficient environmental planning grounds to justify the variation.
The application had first been deferred after the panel said there was not enough information about whether the earlier consent had been physically commenced before the relevant date. The applicant was asked to provide evidence that DA/157/2021 had been physically commenced before 7 May 2026.
The applicant provided documents before 30 June 2026, and additional material was sent to council along with a supplementary report emailed to the panel on 7 July 2026. That report said the new information and amendments had addressed the reasons for deferral and recommended approval subject to conditions.
For Maroubra residents, the approved works are now cleared to proceed at the single residential site. The project remains tied to the conditions attached to the supplementary report, but the panel’s ruling removes the planning hurdle over the height standard and the status of the earlier consent.
