295 Lords Place demolition and alterations approved after condition changes

The owner of 295 Lords Place, Orange, can proceed with approved demolition and dwelling alterations after Orange City Council revised two consent conditions under section 8.2 of the Environmental Planning and Assessment Act 1979.

The approval covers DA 439/2025(1) at Lot 25 DP 826425. The wording of conditions 4(d) and 4(e) was revised in the Notice of Approval.

Councillors present approved the application unanimously, with no votes against. Cr T Greenhalgh declared a significant pecuniary interest because she is a regular customer of the applicant. She left before discussion and voting and returned after the item was decided.

Cr S Peterson said an 84-page report was an excessive burden on an owner changing the colour and material of window frames. The chief executive officer said legislation had since changed to simplify the process, but the applicant chose to apply for the section 8.2 review rather than wait for the change to take effect.

The approval remains subject to the conditions in the Notice of Approval. The supplied details do not specify a construction timetable, project cost or the final window-frame materials and colour.

The application was one of five development applications approved by the Planning & Development Policy Committee on 4 August.

The other approvals covered tree removal at 37 Molong Road; pub alterations and additions, along with hotel and motel accommodation, at 281-285 and 287-289 Summer Street; a café and kiosk at 1517-1539 Forest Road; and a detached dual occupancy and two-lot Torrens title subdivision at 8 Moorhen Street.

The Moorhen Street approval included updated bushfire conditions and a revised Notice of Determination. The updated map had been certified by the Rural Fire Service after the agenda was published.
