Ian Arnott leaves Wahroonga development vote after conflict declaration
The panel unanimously approved design changes to 13 independent living units at 33B and 35 Clissold Road after the community member withdrew from the item.
Community member Ian Arnott left the Ku-ring-gai Local Planning Panel before it approved design changes to 13 independent living units at 33B and 35 Clissold Road, Wahroonga. He had declared a reasonably perceived conflict of interest and did not vote on the unanimous decision.
Arnott left the public meeting at 1pm and did not hear speakers on the matter. He left the determination meeting at 1.57pm, before the panel considered modification application eMOD0008/26.
The application sought changes to the internal and external design of the development, which was approved under consent DA0370/23. The panel approved the modification under Section 4.56 of the Environment Planning and Assessment Act 1979.
Approval was subject to the conditions in the Modification Assessment Report. Condition 21(ii) was amended to replace a reference to drawing Issue R with Issue W.
The panel said it concurred with Ku-ring-gai Council’s recommendation and the modified conditions, as amended in the resolution. Eleven submissions were received and considered as part of the determination.
The Wahroonga project can proceed with the authorised design changes, subject to the modified conditions. Arnott was absent from the discussion and the unanimous vote on the modification because of his declared conflict.
The panel also unanimously refused three other development proposals that day. They were a two-storey dwelling with a basement, swimming pool, cabana and tennis court at 8 Rushall Street, Pymble; a six-storey residential flat building containing 33 units at 3-5 Memorial Avenue, St Ives; and a dwelling, tree removal, landscaping and stormwater works at 97 Babbage Road, Roseville Chase.
A separate Rosedale Road matter involving 120 and 124 Rosedale Road was amended unanimously. The changes added 124 Rosedale Road to an address list, deleted Condition 42 and required car parking allocation to follow Table 7 on Plan DA-001 Revision C, subject to the satisfaction of Council’s Team Leader Development Engineering.
