Two-lot subdivision approved for 2 Westbrook Avenue, Wahroonga
The approval covers demolition and subdivision at 2 Westbrook Avenue, with the works required to start within five years of the Notice of Determination.
A two-lot subdivision at 2 Westbrook Avenue, Wahroonga, has been approved unanimously, allowing the demolition of existing structures and the division of the property into two lots.
Development application eDA0086/26 was approved by the Ku-ring-gai Local Planning Panel on 20 July, subject to conditions in Ku-ring-gai Council’s Development Assessment Report.
The panel approved variations to the minimum subdivision lot size and minimum street frontage standards in clauses 4.1(3) and 4.1(3A) of the Ku-ring-gai Local Environmental Plan 2015. It found the requests met the requirements of clause 4.6.
The panel also found strict compliance with the two standards was unreasonable or unnecessary in the circumstances, and that sufficient environmental planning grounds supported the variations. It was satisfied the development was in the public interest.
One submission was received during notification under Council’s Community Participation Plan and was considered in the determination. The panel concurred with the recommendation in the Development Assessment Report and its consent conditions.
The consent has a five-year commencement limit. Under section 4.53 of the Environmental Planning and Assessment Act 1979, the approval will lapse if the approved works are not physically commenced within five years of the Notice of Determination.
The Wahroonga approval was one of three development applications determined unanimously on 20 July. The panel refused a proposal to subdivide one lot into two and build a dwelling on proposed Lot 121, fronting Reservoir Road, at 12 Bungalow Avenue, Pymble.
It also refused an application for six townhouses with basement parking at 14 Graham Avenue, Pymble. The site did not meet the minimum dimensions in clause 6.6(2)(a) of the Ku-ring-gai Local Environmental Plan. The panel found that control was standalone and overrode other provisions, including clause 4.6.
