Gold Coast keeps legal appeal advice secret after closed-door special meeting
A special City of Gold Coast meeting considered a court appeal matter in closed session, then voted to keep the key attachment confidential and act on a recommendation not released publicly.
City of Gold Coast has kept the details of a legal appeal matter out of public view after a special meeting at council chambers in Surfers Paradise on 26 March.
In public minutes, councillors moved into closed session to consider an update on the appeal, Nucrush Pty Ltd v Council of the City of Gold Coast & Ors, under a provision covering legal advice or legal proceedings involving the local government. After returning to open session, council unanimously resolved that a confidential attachment to the report would remain confidential unless the Chief Executive Officer decided otherwise.
Council also resolved to proceed in line with a recommendation contained in Attachment 4, but that attachment was tabled and redacted in full in the released minutes. The public record does not disclose the substance of the recommendation or the action approved.
For residents, the practical effect is limited public visibility over a decision that has been made on a legal matter. The minutes do not set out any new public policy, budget allocation, planning approval or service change arising from the resolution, and the attachment will not be available unless the Chief Executive Officer later releases it.
