A residential flat building proposed for 68 - 72 Park Road, Kogarah Bay, has been refused after the Georges River Local Planning Panel found six amended plans still lacked the information needed to assess the building’s height and design.

The panel voted unanimously against Development Application DA2026/0146, which sought the demolition of existing structures and construction of a residential flat building at the site.

The applicant’s architect submitted six amended plans covering elevations and basement parking. The panel said they did not include sufficient survey information, including Australian Height Datum levels, to determine the building’s height from existing ground levels and establish whether a Clause 4.6 variation would be required.

The panel did not assess the amended plans in detail because the new plans had not been properly submitted on the planning portal or assessed by council officers.

It also rejected the applicant’s request for deferred commencement consent to allow a full set of plans to be prepared.

The refusal cited failures under the Georges River Local Environmental Plan 2021, including the maximum building height, exceptions to development standards and design excellence. The panel also found the proposal failed to satisfy requirements under the State Environmental Planning Policy (Housing) 2021.

Other reasons included failures against the Apartment Design Guide covering the public-domain interface, separation distances between buildings, car parking and private open space for ground-floor apartments. The refusal also cited a failure to satisfy the relevant design requirements for apartments.

The panel inspected the site and nearby locality before considering the application on 17 September. Chris Tsioulos, a consultant for the applicant and owner, addressed the panel.

The panel’s stated reasons included the proposal’s failure to satisfy the maximum building height standard and relevant design and amenity requirements. The application was refused under section 4.16(1)(b) of the Environmental Planning and Assessment Act 1979.
