Burwood advances LEP changes tied to community infrastructure in high-density areas
Proposed amendments to Burwood LEP 2012 will now be sent for Gateway determination, with public exhibition to follow if the state agrees.
Burwood Council has advanced a planning proposal to change parts of the Burwood Local Environmental Plan 2012, aiming to support delivery of community infrastructure across a broader catchment of high-density development in the local government area.
At its 28 April meeting, the council endorsed sending the proposal to the NSW Department of Planning, Housing and Infrastructure for Gateway determination. The public minutes show the changes would amend clauses 4.3A and 4.4A, which deal with exceptions to height of buildings and floor space ratio.
The report before councillors said the proposal would expand bonus floor space provisions beyond Burwood Town Centre to higher-density zones including R1 General Residential, R3 Medium Density Residential, E1 Local Centre and MU1 Mixed Use. It also said the amendments are intended to support community infrastructure more broadly across the LGA, while requiring design excellence, an appropriate response to local character and improved sustainability performance.
For residents and developers, the proposal could affect how extra height and floor space provisions operate in higher-density parts of Burwood. The minutes describe it as part of a broader approach to linking development capacity with community infrastructure delivery.
Council's resolution also allows the General Manager to make minor numerical, typographical, interpretative or formatting corrections if needed. The Burwood Local Planning Panel had already endorsed the planning proposal for progression to Gateway determination, the report said.
If the state issues a Gateway determination, the proposal will go on public exhibition for at least 28 days, with consultation carried out under the Environmental Planning and Assessment Act 1979. The results of the Gateway process and community consultation are to be reported back to council.
The same report noted that review of the separate Draft Burwood Planning Agreement Policy 2025 is still underway following community submissions and will return to council at a later date.
